WHAT INFORMATION DO WE COLLECT?

When you subscribe and enter payment details, you provide them to the Stripe payment system. All payment data is transmitted to and stored by Stripe. We work with Stripe. If you purchase a subscription through app stores such as the Apple App Store or Google Play, all payments, subscription management, and refunds are governed by the policies of the respective platforms. We do not process or control such transactions, and any questions regarding payments, refunds, or subscription cancellation must be addressed directly to Apple or Google.

4.4. Social media data

If you choose to register on our platform through social networks (Apple, Facebook, Google, and others), we receive information from these services in accordance with your privacy settings. This may include:

  • First and last name (if provided in the social profile);
  • Email address linked to the account;
  • Profile image (if the social network allows it to be shared);
  • Other publicly available information within your account settings.

8.1. To ensure stable platform operation and improve user experience, we use third-party services that may receive limited data about you:

  • Google Analytics — collects anonymous data about visits and interactions (pages, session time, devices). This helps us analyze user activity and optimize the platform.
  • Payment systems (Stripe, etc.) — if you make a payment, your data (card number, payment amount) is processed through secure payment gateways. We do not store and do not have access to full card details. Stripe stores them; their policy is available at: https://stripe.com/privacy.
  • Email delivery services (Mailchimp, SendPulse, etc.) — if you subscribe to newsletters, your email may be shared with these services to send emails.
  • Subscription platforms (Apple App Store, Google Play) — if you subscribe through third-party app stores such as Apple or Google, all payments and subscription management are performed directly by those platforms. We do not process these transactions and do not have access to payment data provided through Apple or Google. Therefore, any questions regarding refunds, payments, or subscription cancellation must be directed to the relevant platform support.

9. Government authorities as required by law

In certain cases, we may share your data with government authorities or law enforcement if:

  • We receive an official request in connection with litigation or another legal process.

TERMS OF USE FOR BEFLUENT AND BEFLUENT CAMP ONLINE PRODUCTS

GENERAL PROVISIONS

15. Scope

These Terms of Use govern access to and use of the platform, including websites, mobile applications, and other related services and educational initiatives associated with BeFluent Company.

15.1. By registering on the platform, the user agrees to these Terms.

15.2. Before registering on the platform or using any BeFluent Company product, the user must review these Terms of Use and the Privacy Policy.

15.3. When creating an account on any Company website, application, or other educational initiative, the user confirms acceptance of these documents by checking the relevant box during registration.

15.4. If the user does not agree with any provisions, the user may not register or use the platform.

15.5. User consent includes:

  • Permission to process personal data under the Privacy Policy.
  • Acceptance of platform use rules, including age restrictions and service usage procedures.
  • The platform administration reserves the right to deny registration or block an account if violations are identified.

Continued use after registration constitutes full and unconditional acceptance of these Terms of Use and the Privacy Policy.

Registration and Account

16. What data is required for registration

16.1. To create an account, the user must provide:

  • First and last name (or a pseudonym, if permitted by the platform);

Social login:

  • If the user signs in via Apple, Google, Facebook, or other services, the platform receives access to public profile data (e.g., name and email).

The user must provide accurate information only. If false information is identified, the account may be blocked at the discretion of the administration of BeFluent Company websites, applications, and other educational initiatives.

16.2. Account deletion or blocking

Account deletion upon request:

  • After identity verification, personal data will be deleted within 30 days, except where required by law (e.g., payment record retention).

Blocking by administration:

An account may be temporarily or permanently blocked if the user:

  • Violates these Terms of Use or the Privacy Policy;
  • Uses the platform for fraudulent purposes;
  • Distributes prohibited content, insults other users, or commits other actions contrary to platform rules.

16.3. Re-registration after blocking

Re-registration after a block is permitted only with authorization from the administration of BeFluent Company websites, applications, and other educational initiatives.

Transfer of accounts to third parties:

  • User accounts are personal and non-transferable.
  • Users may not sell, gift, or transfer their account to another person.
  • If the administration determines that an account is being used by someone else, the account may be blocked.

The user is fully responsible for account security. If account credentials are compromised (e.g., hacking), the user must contact support immediately.

PAYMENT FOR SUBSCRIPTIONS ON THE BEFLUENT PLATFORM

17. Payment methods and subscriptions

We offer multiple payment and subscription options for access to materials and additional platform features.

17.1. Payment methods:

  • Bank cards (Visa, MasterCard, American Express, etc.)
  • Stripe, as well as Google Pay and Apple Pay if the subscription is purchased through an app marketplace

17.2. Subscription types:

  • One-time purchase — access to a specific course or material without renewal
  • 1-month, 6-month, 12-month subscriptions — recurring payments for content access
  • Trial version — a free subscription that provides unlimited access to BeFluent Basic privileges for 3 days; thereafter, charges are applied to the card linked by the user during trial registration.

17.3. Important: Payments are processed through the payment services listed above, and we do not store full card details.

18. Payment policy on the BeFluent platform

18.1. During the BeFluent Premium trial, the "Online Lesson" benefit is unavailable. You must wait until the trial ends and the subscription is paid, or pay early.

18.2. During the BeFluent Premium trial, BeFluent Camp benefits are unavailable. You must wait until the trial ends and the subscription is paid, or pay early.

18.3. All payments are non-refundable, and refunds or credits for virtual goods or partially used subscription periods are not provided, except where required by the laws of your jurisdiction. If you cancel a paid BeFluent subscription, you will retain access until the end of the current paid period. Please note: if you made purchases in BeFluent through the Apple App Store or Google Play, payment processing is handled by Apple or Google respectively.

19. Payment policy for the BeFluent Camp educational initiative

19.1. During the BeFluent Premium trial, BeFluent Camp benefits are unavailable. You must wait until the trial ends and the subscription is paid, or pay early.

19.2. Refunds are available within 7 calendar days from the start date of the current BeFluent Camp.

USER OBLIGATIONS

20. Prohibited actions

The following actions are prohibited:

  • Fraud and deception — misleading the administration, instructors, or other users (e.g., providing false data or impersonating another person).
  • Copyright infringement — copying, distributing, or using platform materials without permission (courses, videos, tests, teaching materials, and other educational resources).
  • Insults and discrimination — use of offensive language, hate speech, or discrimination on any grounds (race, nationality, religion, gender, etc.).
  • Spam and advertising — using the platform to send unsolicited advertising, links to third-party resources, or viruses.
  • Unauthorized access and hacking — attempts to hack accounts, bypass security systems, or test the platform for vulnerabilities without authorization.

If a violation is identified, the platform administration reserves the right to block the user's account without a refund.

21. Use of BeFluent platform materials and other educational initiatives (personal and commercial)

Personal use: all materials are provided exclusively for personal learning. The user receives a limited, non-exclusive, non-transferable license to use the content without the right to distribute it.

Commercial use is prohibited. The user may not:

  • Sell, distribute, copy, or transfer materials to third parties.
  • Publish, upload, or make publicly available (including social networks, file-sharing services, forums, and other platforms) any content obtained during learning.
  • Use platform educational resources in third-party commercial projects.
  • Conduct lessons using platform materials or other BeFluent Company educational initiatives.

22. Consequences of violation

Violation of these terms is considered unlawful use of BeFluent Company intellectual property. In such cases, the Company reserves the right to:

  • File a lawsuit for copyright infringement and seek damages.
  • Block the violator's account without reinstatement or refunds.
  • Provide information about the violator to law enforcement in cases of large-scale or systematic piracy.
  • Send a formal cease-and-desist notice with the possibility of further legal action.

22.1. Warning: Unlawful use of platform materials may result in civil, administrative, and criminal liability under applicable law.

Access to Content and Its Use

23. Ownership of materials

All materials presented on the platform are the Company's intellectual property and are governed by these Terms of Use.

23.1. Availability after subscription ends

23.2. Depending on the subscription type, the user may be granted limited or full access to materials.

23.3. If the subscription expires, access to premium materials (courses, video lessons, tests, additional materials) may be restricted.

23.4. One-time purchases (e.g., a course without a subscription) may remain available without time limits (or for 4 months if BeFluent Camp is used), unless otherwise stated in the product description.

23.5. The user may not require continued access after a subscription ends without paying for the next period.

23.6. BeFluent Company reserves the right to change content access conditions based on Company policy and platform development.

24. Is downloading or copying content allowed?

24.1. Downloading, copying, distributing, or otherwise reproducing platform content without explicit permission is prohibited.

24.2. Users may not upload, distribute, transmit, or publish course materials on third-party resources (including social networks, file-sharing services, or forums).

24.3. Materials may be used only for personal educational purposes, without transfer to third parties.

24.4. The platform may provide limited downloading of certain files (e.g., PDFs), but further distribution is prohibited.

24.5. For violations, the Company reserves the right to file a claim to protect copyrights and to block the user's account without a refund.

25. Copyright in courses and materials

25.1. All courses, video lessons, teaching materials, articles, tests, and other educational resources are the intellectual property of BeFluent Company.

25.2. Any commercial use, including resale, publication, or translation without permission, is a copyright violation.

25.3. The user does not acquire ownership rights to content, only a license to use it within the platform.

25.4. Logos, branding, design, and other platform elements are also protected by copyright.

Limitation of Liability

26. Platform operation and outages

We make every effort to ensure uninterrupted platform operation. However, in rare cases technical disruptions may occur, and 100% uninterrupted operation of any digital service cannot be guaranteed.

26.1. Liability for errors and disruptions

26.2. We strive to ensure uninterrupted operation of the platform and other BeFluent Company educational initiatives, but we cannot guarantee that the service will always be available without errors.

26.3. The administration is not responsible for temporary failures, delays, or data loss caused by:

  • Technical issues with servers or hosting.
  • Failures in the user's internet connection.
  • Hacker attacks or actions of third parties.
  • Platform updates or maintenance work.

26.4. We reserve the right to temporarily suspend services to address technical issues without prior notice.

26.5. If an outage affects access to paid content, the matter will be handled individually through support.

26.6. The Company is not liable for losses caused by technical issues on the platform, or disruptions due to force majeure.

26. Disclaimer of warranties (no 100% guarantee of successful language learning)

26.1. We provide educational tools but do not guarantee that a user will reach a specific level of language proficiency.

26.2. Learning success depends on the user's personal effort, involvement, consistency, and completion of tasks.

26.3. Any results presented on the platform (e.g., examples of other students' success) are informational and do not guarantee similar outcomes for every user.

26.4. The Company is not responsible for:

  • Failure to achieve expected learning outcomes.
  • Errors in materials (we aim to correct inaccuracies promptly upon discovery).
  • Use of knowledge gained on the platform in professional or academic activities.

Learning on the platform or other BeFluent Company educational initiatives is a tool, but the final result depends on the user.

Changes to the Terms of Use

27. Updates

We reserve the right to change these Terms of Use at any time to comply with changes in law, platform updates, or new security requirements.
